In short

1. This agreement

These terms are the agreement between you and Faiz Ahmad Dae (“we”, “us”), the developer of the game «کافه جدول» (Cafe Jadval), about your use of the game. By installing or using it you accept them. If you do not accept them, do not use the game.

The agreement is with us, not with Apple or Google. They distribute the app and handle payment; they do not operate the game. Their own terms apply to their part.

How we handle data is described separately in the privacy policy, which forms part of this agreement.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the game on devices you own or control, for your own private, non-commercial use, for as long as you keep to these terms.

You are not buying the game or any part of it. Everything not expressly granted here stays with us.

3. What is free

All of the game's content is free. Every chapter, every board and the daily puzzle cost nothing. There is no subscription, no premium tier and no paid pack, and no purchase unlocks content.

Stages inside a chapter open in order: you solve the first unfinished stage to reach the next. Neither coins nor a video ever skips that order. Choosing a chapter and playing the daily puzzle are free of it.

4. Coins

Coins are an in-game currency. They buy hints — a letter or a word — and nothing else. You earn them by playing, from a daily gift, and from rewarded videos; you can also buy them.

You should understand the following before you buy, because it is unusual and we would rather say it plainly than bury it:

Prices are set per country by Apple and Google and are shown in the game before you confirm. We may change prices, the contents of a pack, or what a hint costs, for the future; a change never removes coins you already hold.

5. Rewarded video

The game may offer a rewarded video in exchange for coins. Watching one is always your choice. There is no banner, no full-screen ad between puzzles, and no ad when you open the app. Nothing interrupts a board you are solving, and no ad is shown before your fourth puzzle.

Ads are supplied by Google AdMob. We do not choose or control the individual ads, and an advertiser's claims are theirs. Whether a video is available at a given moment depends on Google, not on us; if none is available, the reward is simply not offered. Section 5 of the privacy policy describes what Google processes and how to change your consent.

If a video finishes and the reward does not arrive, the game remembers the debt and credits it on a later attempt. Beyond that, we cannot pay a reward for a video Google did not report as watched.

6. Refunds and the right of withdrawal

Purchases are made through Apple or Google, and refunds are theirs to give. We cannot issue one, because we never receive your payment. Ask them: Apple · Google Play. If a store refunds a purchase, we may remove the corresponding coins.

Consumers in the EU and the UK. Coins are digital content delivered immediately. When you confirm a purchase you ask for performance to begin at once and acknowledge that you thereby lose the 14-day right of withdrawal for that purchase (Art. 16(m) of Directive 2011/83/EU and the equivalent UK rules). This does not touch your statutory rights if the content is faulty or not as described.

The boards, the clues, the explanations, the artwork, the sounds, the name and the code are our own work or licensed to us, and are protected by copyright. The grids are authored for this game, not copied from another publisher.

The game uses open-source components and typefaces under their own licences. The full list, with each licence, is in the app under Settings → Licenses.

If you believe something in the game infringes your rights, write to support@topjow.org with enough detail to identify it, and we will look into it.

9. Availability and changes

The game runs on your device and works offline, so it does not depend on a service of ours staying up. We do not promise that it will always be available in every country or on every device, that it will keep working on a future operating system, or that updates will continue.

We may change, add or remove features. We will not remove puzzles you have already solved or coins you already hold as part of an ordinary update. If we ever withdraw the game from a store, boards you have installed keep working until you uninstall it.

10. Warranty

The game is provided “as is”. To the extent the law allows, we give no warranty that it will be uninterrupted or error-free, or that every clue and answer is beyond dispute — the content is written by people and may contain mistakes. Tell us about one and we will fix it.

This does not limit the statutory rights of a consumer, including the rights that EU and UK law give you when digital content is faulty or not as described. Those rights apply whatever this section says.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost data, lost time, or lost coins arising from your use of the game, and our total liability for any claim connected with the game is limited to the amount you paid us through the stores in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or, where German or other applicable law so provides, for intent and gross negligence and for culpable breach of an essential contractual duty.

12. Age

The game is for a general audience and is not directed at children. You must be old enough to enter into this agreement where you live. If you are a minor, use the game and make purchases only with the consent of a parent or guardian, who accepts these terms on your behalf.

For a copy of the game obtained from Apple's App Store, the following also applies, and applies over anything inconsistent with it above:

14. Ending this agreement

You may end it at any time by uninstalling the game; remember that unspent coins go with it (section 4). We may end your licence if you seriously or repeatedly break these terms — in practice, by the app store's own mechanisms, since we have no account to close.

Sections 4 (what coins are), 8, 10, 11 and 15 survive the end of this agreement.

15. Governing law

These terms are governed by the law of the United States and of the state in which the developer resides, without regard to conflict-of-law rules.

If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of that country. Nothing here requires arbitration or waives a class action.

We are not obliged, and are not willing, to take part in dispute-resolution proceedings before a consumer arbitration board.

16. Changes to these terms, and contact

We may update these terms when the game changes. The version published here, with the date at the top, is the one that applies. A material change will be announced in the app, and continuing to use the game after that means you accept it. If you do not, uninstall the game.

If part of these terms turns out to be unenforceable, the rest stays in force.
